Texas Attorney General Ken Paxton has taken legal action against Pfizer, Inc., accusing the pharmaceutical company of deceptive practices and misrepresentation regarding the effectiveness of its COVID-19 vaccine. Paxton alleges that Pfizer made unsupported claims about the vaccine's efficacy and attempted to censor public discussion of the product.
According to the lawsuit, Pfizer engaged in false, deceptive, and misleading acts in violation of the Texas Deceptive Trade Practices Act. The company's widespread representation of its vaccine having a 95% efficacy against infection was deemed highly misleading. It was revealed that this metric was based on a calculation of the "relative risk reduction" observed during Pfizer's initial two-month clinical trial results, which the FDA has stated can unduly influence consumer choice.
Furthermore, Pfizer was made aware that the duration of vaccine protection couldn't be accurately predicted beyond two months, yet the company failed to disclose this information to the public. The lawsuit accuses Pfizer of fostering a misleading impression that vaccine protection was long-lasting despite being aware of the limitations. Additionally, Pfizer's clinical trial did not measure whether the vaccine protects against transmission, but the company embarked on a campaign to encourage the public to get vaccinated as a means of protecting loved ones.
However, the lawsuit alleges that Pfizer's product did not live up to the efficacy claims. Following widespread vaccine administration, COVID-19 cases increased, and in some areas, a higher percentage of deaths occurred among the vaccinated population compared to the unvaccinated. When faced with the failure of its product, Pfizer shifted its focus towards silencing critics and those spreading the truth. The lawsuit highlights Pfizer's attempts to label truth-tellers as criminals, accusing them of spreading misinformation, and pressuring social media platforms to silence prominent voices.
Attorney General Paxton stated, "We are pursuing justice for the people of Texas, many of whom were coerced by tyrannical vaccine mandates to take a defective product sold by lies. Pfizer did not tell the truth about their COVID-19 vaccines." He further criticizes the Biden Administration's handling of the pandemic, alleging that it used the situation to enforce unlawful public health decrees and benefit pharmaceutical companies.
This lawsuit follows Attorney General Paxton's earlier investigation into Pfizer and other vaccine manufacturers. The investigation aimed to uncover any potential fraudulent activity related to COVID-19 vaccines.
The outcome of the lawsuit will be closely monitored, as it could have significant implications for how pharmaceutical companies communicate the efficacy of their vaccines and the extent of their legal responsibility in representing their products accurately.
