In a recent update to the case involving the attack on former House Speaker Nancy Pelosi's husband, prosecutors are calling for a 40-year sentence for David DePape, the man found guilty of using a hammer in the assault. DePape was convicted in November on charges of assault on a federal official's immediate family member and attempted kidnapping of a federal official.

According to a memorandum filed by the Department of Justice on Friday, DePape's actions were deemed as "a federal crime of terrorism." The DOJ argues that his assault was calculated to intimidate or coerce the government or retaliate against government conduct, thus including the attempted kidnapping of a Member of Congress.

During the trial, DePape's attorney, Jodi Linker, admitted that her client attacked Paul Pelosi, but contested that his motivation did not match the charges he faced. Linker argued that DePape struck Pelosi in a moment of despair when his larger plan was thwarted by the arrival of the police. However, the DOJ's memorandum suggests that DePape's actions must be seen in the context of their impact on democracy and fundamental values.

Testifying in court, Paul Pelosi recounted the horrifying night of the attack, describing how he woke up to find a man wielding a hammer in their home. When asked about his wife's whereabouts, Pelosi informed the attacker that she was in Washington, not at home. An intense struggle ensued, resulting in Pelosi suffering a skull fracture and injuries to his hand and arm.

The Department of Justice emphasized that these crimes should serve as a deterrent to others, particularly during a time when extremism has led to attacks on public and elected officials. The DOJ's memo highlighted the need to send a strong message to individuals harboring violent and ideologically motivated dreams and plans.

DePape's federal sentencing is scheduled for May 17th, and he still faces state charges in California, including attempted murder, burglary, and assault. He has entered a plea of not guilty to these charges.

The outcome of this case will not only determine the fate of David DePape but also serve as a reflection of society's stance against violence targeting public figures. As the sentencing date approaches, the prosecution's recommendation of a 40-year sentence awaits the final decision of the court.
