Former Virginia Assistant Principal Indicted in Connection with School Shooting

In a groundbreaking case, a former assistant principal at Richneck Elementary School in Virginia has been indicted in connection with the high-profile shooting of a teacher by a 6-year-old student. The indictment marks the first time an administrator has been charged in relation to the handling of a school shooting.
The indictment, which includes eight counts of child abuse, was issued by a special grand jury in Newport News on March 11. This comes over a year after the shooting took place and gained national attention due to the young age of the shooter. Court records, recently made public, reveal the charges against Ebony Parker.
Although the specifics of the charges have not been provided by Newport News prosecutors, they have stated that the special grand jury, formed to investigate any security lapses leading to the shooting, will release a report on its findings on Wednesday. The panel commenced its proceedings in September.
Abigail Zwerner, the teacher who was shot and seriously wounded, has filed a $40 million lawsuit alleging that Parker was notified at least three times on the day of the shooting in January 2023 about the presence of a gun in the possession of the 6-year-old student. Zwerner maintains that Parker failed to take any action, resulting in the shooting. Parker's attorney, while not immediately commenting on the matter, has denied the allegations in response to the lawsuit. Parker resigned from Richneck following the shooting incident.
Experts believe that this case could set a precedent. Ron Avi Astor, a professor of social welfare at UCLA who studies school shootings, suggests that the prosecution of Parker may indicate a change in how such incidents are addressed, driven by the increasing occurrence of gun violence on school campuses. Astor emphasizes that given the availability of data, reporting, and training, it is crucial for school administrators to address and investigate any warning signs.
Prosecutors have demonstrated an increasing willingness to pursue criminal charges for negligence leading to school shootings. One such example is the recent sentencing of the parents of the Michigan teen who carried out the deadly shooting at Oxford High School in 2021. They were convicted of involuntary manslaughter for failing to prevent the incident. In the Richneck case, the mother of the 6-year-old shooter previously pleaded guilty to gun charges in federal court and child neglect in state court in relation to the incident.
The closest parallel to the case against Parker was the trial of a school resource officer who was acquitted of inaction during the 2018 Parkland High School massacre in Florida, where 17 people were killed.
Newport News Commonwealth's Attorney Howard E. Gwynn formed an 11-person special grand jury in April to investigate any actions or omissions by current or former employees of the Newport News School System that may have contributed to the Richneck shooting.
The incident unfolded on January 6, 2023, when the 6-year-old boy brought a gun to school in his backpack after taking it from his mother's unsecured purse at home. Zwerner's lawsuit claims that she informed Parker earlier that day about the child's violent behavior and threats. Several students subsequently reported that the boy had a gun, but Parker allegedly failed to take appropriate action, dismissing the concerns based on the size of the boy's pockets.
Around 2 p.m., the boy fired a single shot at Zwerner as she was teaching in her first-grade classroom. Zwerner exhibited quick thinking and managed to evacuate all her students before being rushed to the hospital with life-threatening injuries. She has since been released and is recovering at home after multiple surgeries. The 6-year-old shooter was apprehended by a teacher and is now under the care of his great-grandfather.
The Richneck shooting sparked outrage among parents and teachers, who criticized school officials and the district's approach to handling the incident as well as other instances of violence that occurred in Newport News schools within a short time span.
As this unprecedented case unfolds, it may set a new precedent for accountability in school shootings and prompt further examination of security measures and the duties of school administrators.
