Death of D'Vontaye Mitchell Ruled Homicide as Autopsy Report Reveals Restraint Asphyxia

In a tragic incident that has drawn comparisons to the killing of George Floyd, D'Vontaye Mitchell, a Black man, died after being pinned to the ground by hotel security guards in Milwaukee. The Milwaukee County medical examiner's office has officially ruled Mitchell's death as a homicide, according to their recently released final report on the cause of death.

The autopsy revealed that Mitchell, 43, died as a result of restraint asphyxia, compounded by the effects of cocaine and methamphetamine in his system. It was noted that Mitchell had been restrained by multiple individuals after he had allegedly used drugs. The family's attorneys, in a statement issued by lawyer Ben Crump, have called for immediate charges to be filed against the security guards involved.

While prosecutors have been investigating the incident, they have been awaiting the results of the autopsy to determine potential charges against those involved. However, the Milwaukee County district attorney's office has yet to comment on the matter.

The medical examiner's report also pointed out that Mitchell had underlying health conditions, including hypertensive cardiovascular disease and obesity. Mitchell's family believes he was experiencing a mental health crisis when he entered the Hyatt Regency Milwaukee on June 30. According to the investigation conducted by the medical examiner, Mitchell appeared frantic and tried to hide in the lobby. Subsequently, security guards proceeded to drag him out of the hotel premises.

Witness video footage and the investigation corroborate that outside the hotel, four security guards pinned Mitchell face down on the concrete until the arrival of the police. The distressing video shows Mitchell pleading for help and expressing remorse while the guards seemingly exerted force to keep him restrained. Although the police and emergency responders attempted resuscitation upon their arrival, Mitchell tragically passed away at the scene.

The hotel in question is managed by Aimbridge Hospitality, which took swift action by terminating employees following Mitchell's death. Authorities have not disclosed the identities of the four guards involved in the incident.

The untimely death of D'Vontaye Mitchell has sparked national outrage and reignited conversations about the excessive use of force by security personnel and the ongoing problem of police violence against Black Americans. The medical examiner's office defines homicide as a death resulting from the actions of another individual, regardless of intent, an independent definition separate from the legal interpretation of the term.

Mitchell, who was married and had two children, had reportedly faced struggles with mental health issues since the passing of his father in 2016. Describing the hotel workers' response as an excessive use of force leading to his fatal injuries, Mitchell's family and their attorneys have vowed to pursue justice.

"We will not rest until we achieve justice for Mitchell and his grieving family," stated attorney Ben Crump in the family's released statement.

As the investigation continues, the focus now turns to the legal ramifications that the security guards may face for their actions, as the family seeks tangible accountability for the tragic loss of their loved one.
