In a shocking turn of events, the man who carried out the attack on former House Speaker Nancy Pelosi's husband, Paul Pelosi, has been handed a life sentence without the possibility of parole for aggravated kidnapping. David DePape, aged 44, was convicted on Friday by a San Francisco jury on multiple charges, including first-degree burglary, false imprisonment of an elder, threatening a family member of a public official, dissuading a witness, and aggravated kidnapping.
The state trial resulted in the additional convictions, coming just weeks after DePape had already been sentenced to 30 years in federal prison for the 2022 attack on Paul Pelosi. The brutal assault, captured on police body camera video, left Pelosi with two head wounds, including a skull fracture that required plates and screws for his recovery. He also sustained injuries to his right arm and hand.
In response to the convictions, Speaker Pelosi's office expressed admiration for her husband's bravery and resilience throughout the ordeal. They emphasized his courageous testimony in the trial, praising his ability to save his own life during the attack. The family has been amazed by Paul Pelosi's extraordinary courage and fortitude over the past 20 months of his recovery.
Public defender Adam Lipson, representing DePape, expressed disappointment with the verdict and announced plans to appeal. Lipson called the prosecutors' decision to file a kidnapping for ransom charge "vindictive." However, San Francisco District Attorney Brooke Jenkins defended the charges and denied any accusations of vindictive prosecution, stating that they were simply seeking to hold DePape accountable for his criminal acts on that fateful night.
The defense had argued that the state trial constituted double jeopardy, as it followed the federal conviction. However, San Francisco Superior Court Judge Harry Dorfman agreed with this assertion and dismissed the state charges of attempted murder, elder abuse, and assault with a deadly weapon. The decision was later upheld by another judge on appeal.
Following the completion of his 30-year federal prison sentence, DePape will be transferred to a California prison to serve the remainder of his life term. During the federal trial, DePape was found guilty of assaulting a federal official's family member and attempting to kidnap a federal official. This resentencing hearing was the result of judicial error.
During the trial, Assistant District Attorney Phoebe Maffei presented evidence suggesting that DePape's primary intent was to confront and potentially harm Nancy Pelosi. She argued that DePape planned to record a video of his interrogation of the former Speaker of the House. In her closing arguments, Maffei emphasized that DePape had admitted to wanting to obtain a video of Nancy Pelosi confessing to what he believed were crimes and planned to post it online.
The attack on Paul Pelosi on October 28, 2022, sent shockwaves through the political world just days before the midterm elections. The severity of his injuries left a lasting impact, with the skull fracture requiring surgical intervention and permanent fixtures. As the legal proceedings come to a close, justice has been served, and the Pelosi family can find some solace in knowing that their ordeal is reaching a resolution.
