Melnick's actions, which included failing to notify his client and neglecting to respond to the motion, were deemed intentional, causing harm to the client.

The recommendation for suspension was based on Melnick's prior disciplinary record, which includes reprimands in 2003 and 2006 for violating Rules 1.3 and 1.4. These rules require attorneys to act with reasonable diligence and maintain effective communication with their clients.
