In a court hearing at Wrentham District Court, Justin Mitchell, 39, and John Vieira, 59, pleaded not guilty to charges of disorderly conduct and assault and battery in relation to a fatal fight that occurred during a Patriots game. The incident resulted in the death of 53-year-old Dale Mooney.

Mitchell, denying the allegations against him, appeared in court on Friday, a week after Vieira did the same. According to CBS News, Vieira had confidently stated his innocence to reporters as he left the court.

During the hearing, Mitchell was ordered to stay away from Gillette Stadium, Mooney's family, and any potential witnesses. Both accused individuals are residents of Warwick, Rhode Island. They are being accused of punching Mooney in the head, which was partially captured on video during the Patriots' game against the Miami Dolphins on September 17th.

Following Mooney's collapse and subsequent death, the Norfolk District Attorney's Office declared his passing as a homicide. However, after reviewing available evidence, including autopsy results and multiple videos, District Attorney Michael Morrissey stated that there was insufficient basis to charge Mitchell or Vieira with homicide.

According to a police report obtained by the Boston Globe, Mooney was involved in a verbal altercation with Mitchell, who was wearing a Dolphins jersey, as well as another member of Mitchell's group, 39-year-old George Chiarillo. Witnesses reported that Mooney had expressed a desire to fight and had attempted to provoke Mitchell before the fatal incident.

The police report further stated that Vieira intervened and was seen delivering a single punch to Mooney's head, described as a "glancing blow." Mooney's cause of death was listed as "probable cardiac dysrhythmia in a person with severe hypertensive and atherosclerotic cardiovascular disease during a physical altercation."

As the legal proceedings continue, Mitchell and Vieira maintain their plea of not guilty, and the tragic circumstances surrounding Dale Mooney's death during the Patriots game remain under investigation.
