In a recent announcement, Middlesex District Attorney Marian Ryan revealed that Henry Del Rio has been indicted by a grand jury on first-degree murder and other charges in connection with the tragic shooting death of Ashlee Berryman in August 2015. Berryman, a 21-year-old mother, was fatally shot outside the Braza Bar and Grill on School Street in Everett.
According to Ryan, Del Rio allegedly fired his gun into a crowd outside the nightclub, striking and killing Berryman, who was simply standing outside at the time. Berryman, affectionately known as Penny to her loved ones, was an innocent victim caught in the hail of gunfire.
At the time of her death, Berryman had a 3-year-old son. She had been at the restaurant with her boyfriend, a local rapper who was scheduled to perform that night. The incident occurred shortly before 1 a.m. when two individuals who were not part of the concert engaged in an argument with one of Del Rio's associates in the parking lot. Del Rio then retrieved a 40 caliber semiautomatic pistol and began firing, according to Ryan.
As the two men involved in the altercation turned and fled, Del Rio continued shooting, hitting one of them in the feet and ankles. Tragically, one of the bullets struck Berryman in the back, proving to be fatal. The indiscriminate gunfire also caused damage to a city sign, a parked car, and a Rite Aid pharmacy window.
Del Rio is currently under federal custody for a separate case and is expected to be transported to Middlesex County to face charges related to Berryman's death in the coming week. Ryan also mentioned that Del Rio is believed to be associated with the East Side Money gang based in Chelsea.
In her statement, Ryan expressed her sorrow over the incident, highlighting the loss of a young mother's life after attending a concert. She also emphasized the dangers of firearms on the streets and the brazen act of shooting into a crowd of people. Ryan noted that it was surprising that more individuals were not injured during the incident.
The indictment of Henry Del Rio offers hope for justice to be served in a case that has left a grieving family and community searching for answers since 2015.
