Federal Judge Orders Biden Administration to Halt Removal of Razor Wire Along Texas Southern Border

In a significant victory for Texas in its efforts to secure the southern border, a federal judge has ordered the Biden administration to cease cutting razor wire on fences along the Rio Grande. The decision comes in response to a lawsuit filed by Texas Attorney General Ken Paxton, who argued that the destruction of state property was being done to facilitate the entry of illegal migrants.

Judge Alia Moses of the U.S. District Court for the Western District of Texas issued the temporary order on Monday, instructing the Department of Homeland Security (DHS) to halt the "disassembling, degrading, tampering" of miles of razor wire near Eagle Pass, Texas.

Paxton's lawsuit claimed that federal officials approved the destruction of state-owned fencing to allow unauthorized individuals to enter and be processed. He emphasized that federal agents had resorted to using hydraulic-powered pallet forks and an industrial-strength telehandler forklift to dismantle the border fence.

According to the motion for a temporary injunction submitted to the court, federal agents deliberately removed not only the concertina wire but also the fencing posts, clamps, and other components, holding them suspended in the air as over 300 migrants were waved into Texas illegally.

Last week, the Department of Homeland Security issued a statement asserting that border agents have a legal obligation to protect migrants from harm, irrespective of their immigration status.

In an 11-page document submitted to the federal court in Del Rio, Judge Alia Moses ruled that Texas had successfully met the four-part test required for a temporary halt to the actions of the federal government. However, the judge noted one exception in her decision.

This recent court order brings relief to Texas, as it prevents further destruction of the state's border infrastructure and reinforces the state's commitment to secure its boundaries. The battle between the Biden administration and Texas regarding immigration policies continues, and this legal victory is likely to have wider implications for border security debates across the nation.
