The state has concluded its presentation in the Adam Montgomery murder trial after calling numerous witnesses over several days. Adam Montgomery, 34, is facing charges of second-degree murder, second-degree assault, witness tampering, abuse of a corpse, and falsifying physical evidence in connection with the death of his 5-year-old daughter, Harmony, in 2019.
During the trial, which is being streamed by WMUR, several disturbing descriptions have been shared, and viewer discretion is advised. The trial can be accessed through the Very Local app on various platforms.
As of now, the defense is expected to commence its case on Wednesday morning. However, Judge Amy Messer has informed the jury that the defense has the option to not call any witnesses, in which case closing arguments will be presented. It is worth noting that Adam Montgomery has not been present in court since the jury selection process. Judge Messer explained that if he waives his right to appear in court on Wednesday, it will also mean waiving his right to testify.
In a recent development, Adam Montgomery's attorney filed a motion to dismiss the charges of second-degree assault, second-degree murder, and witness tampering. However, the judge denied this motion.
The trial also witnessed arguments regarding the exclusion of Kayla Montgomery's testimony from the jury deliberations. The defense submitted a motion on this matter, while the judge is currently reviewing the arguments.
Following a few more witnesses taking the stand, the state announced that it had completed its case. Consequently, the judge dismissed the jury for the day, with proceedings set to resume at 10 a.m. on Wednesday.
In a significant moment, the state concluded its case by presenting a recorded phone call between Adam Montgomery and a police detective, allowing Montgomery to speak in his own words.
Among the emotional moments in court was the testimony of Rebecca Maines, who described Adam Montgomery as her best friend in 2021. She disclosed that he claimed he had returned Harmony to her mother at a rest stop due to the child's persistent bedwetting and toileting accidents. Maines added that Montgomery expressed his dislike for Harmony, stating that she reminded him of her mother, Crystal Sorey.
Meanwhile, it has been reported that Adam Montgomery is once again absent from the trial. It was revealed that his father passed away over the weekend due to an overdose. However, it remains unclear if this is the reason for Montgomery's absence since he has not been physically present in court since jury selection.
While the trial was on break during the holiday weekend, the defense filed a motion to exclude Kayla Montgomery's testimony from the jury deliberations, alleging that the state attempted to influence her trial testimony. The state objected, arguing that the defense's motion was mischaracterized.
As the trial moves forward, tension between the state and the defense appears to be increasing, with recent motions filed by the defense asking for the exclusion of Kayla Montgomery's testimony from jury consideration, claiming the state's attempt to influence her trial testimony.
The Adam Montgomery murder trial will resume at 9 a.m. with testimony expected to continue.
