The lawsuit alleges that the incident took place in August 2015 at the restaurant Catch NYC & Roof. Foxx's spokesperson has pointed out that the same person had previously filed a similar lawsuit in Brooklyn in 2020, which was subsequently dismissed. They assert that the claims made in the current lawsuit are not any more viable, expressing confidence that they will be dismissed once again.

In response to the allegations, Foxx's representatives have announced that the actor is planning to take legal action of his own. They further stated that Foxx intends to pursue a claim for malicious prosecution against the accuser and her attorneys, terming the suit as a "frivolous action."
