Actor Alec Baldwin has been charged with involuntary manslaughter in the fatal shooting of cinematographer Halyna Hutchins on the set of "Rust" in 2021, according to documents obtained by Fox News Digital. This marks the second time Baldwin has been indicted for Hutchins' death, as the charges were initially dropped in April. Baldwin's lawyers expressed their readiness for their day in court following the release of the new charge.
The release of a video from the "Rust" set in November, which showed Baldwin instructing crew members to move aside before firing his weapon, may have played a significant role in the decision to refile charges. Los Angeles-based celebrity attorney Christopher C. Melcher noted that the outtakes demonstrated that Baldwin was following safety guidelines but also revealed his lack of regard for safety when he unintentionally shot Hutchins and director Joel Souza.
Hutchins tragically lost her life, while Souza sustained injuries from a bullet fired by Baldwin during a scene rehearsal at a church in New Mexico on October 21, 2021. Baldwin has consistently denied pulling the trigger of the gun that caused Hutchins' death. Melcher pointed out that while actors are not expected to be gun experts, Baldwin failed to check if the firearm was unloaded or have the prop master do so before pointing it at others – a standard safety procedure on sets.
The video footage, originally released by NBC News, showcased Baldwin's concern for the crew's safety, urging them to move away from the gun's path. Despite this, questions remain about Baldwin's handling of the firearm and the lack of due care.
The prosecution may have a stronger case this time around with the introduction of new weapon testing, which Baldwin vehemently denies ever firing. However, Baldwin's attorneys can argue that testing on a reconstructed gun with different parts may not accurately reflect what occurred with the original weapon. The defense may also highlight any inconsistencies between the two tests. Additionally, proving Baldwin's guilt will require demonstrating his mental state and awareness of the dangers involved.
Former New York prosecutor Rither Alabre stated that when the charges were initially dismissed, it was made clear that Baldwin was not absolved of criminal culpability and that charges could be refiled. Analysts believe that further forensic analysis on the gun led prosecutors to believe they now have the evidence, namely that the gun could not have been fired without someone, namely Baldwin, pulling the trigger.
During the period following the initial charges, public opinion towards Baldwin has shifted. While he initially faced widespread anger and criticism, some now seem to view him more sympathetically, suggesting a partial regain of trust. However, the new involuntary manslaughter charge brings renewed public scrutiny as the case proceeds.
As Baldwin now faces another legal battle and potentially severe consequences, the court proceedings will shed further light on the circumstances surrounding Hutchins' tragic death and the responsibilities of those involved in ensuring on-set safety.
