Trump Calls for Modification of 25th Amendment to Remove Vice President Accused of Covering Up Incapacity

Former President Donald Trump has expressed his desire to modify the 25th Amendment of the Constitution, aiming to allow for the removal of a vice president who allegedly covers up the president's incapacity. Speaking at a campaign rally in Mosinee, Wisconsin, Trump accused Vice President Kamala Harris of concealing President Joe Biden's mental fitness, claiming that he is unfit for office. Trump proposed that any vice president found lying or involved in a conspiracy to cover up the president's incapacity should be subject to impeachment and immediate removal from office.

During his speech, Trump highlighted his belief that if Biden had not participated in the debate, he would still be running for office. He asserted that the 25th Amendment, adopted in 1965 after the assassination of John F. Kennedy, tackles issues related to the removal of a president from office and the succession process in case of death, incapacity, or removal.

Ironically, Trump's own cabinet once considered invoking the 25th Amendment to remove him from power. His former Treasury Secretary Steven Mnuchin revealed to the January 6 Committee that he discussed this option with former Secretary of State Mike Pompeo following the 2021 Capitol riot.

Modifying the 25th Amendment would be a challenging task for Trump. The process requires careful consideration and broad consensus across the nation. An amendment can be proposed either by a two-thirds vote in both the House of Representatives and the Senate or by a national convention called for by two-thirds (34) of the state legislatures. Subsequently, it requires ratification by three-quarters (38) of the state legislatures for it to become part of the Constitution.

A recent poll conducted for Newsweek indicated that more 2020 Biden voters supported using the 25th Amendment to remove him from office than opposed the measure. However, Vice President Harris has consistently defended Biden's mental condition, stating that he possesses the intelligence, commitment, and judgment necessary for the presidency.

Since Biden ended his reelection bid and endorsed Harris, Trump has targeted both the vice president and the media, accusing them of covering for Biden's poor performance in their first debate. Trump has been calling for Biden's removal from office since September 2023. However, his focus has now shifted to Harris as his political opponent in the upcoming election.

Trump's call for modifying the Constitution to remove Harris as vice president appears to be a variation of his previous argument regarding Biden's removal. Trump has recently replaced Biden's name with Harris' in his talking points or used both names interchangeably. During his Wisconsin speech, he mentioned Biden's name 22 times and Harris' name 16 times.

Newsweek has reached out to the campaigns of Trump and Harris for comments but has yet to receive a response.
