In a recent exclusive interview with Fox News Digital, Rep. Anna Paulina Luna, a Republican from Florida, has declared her intention to push for a vote on the arrest of Attorney General Merrick Garland if the Department of Justice (DOJ) fails to take action on a criminal contempt resolution supported by House GOP leaders.
Luna plans to bring her "inherent contempt" resolution against Garland for a vote after the full House of Representatives addresses a separate measure regarding the fate of the Biden administration's official. Expressing her lack of faith in the DOJ, Luna aims to restore a level playing field and emphasize the importance of accountability from the top down.
Inherent contempt, a procedure not used since the early 1900s, differs from the contempt resolution that is scheduled for a vote on Wednesday. While the latter could refer Garland to his own department for criminal charges, inherent contempt, if passed, would direct the House sergeant at arms to personally arrest Garland.
To educate her colleagues on inherent contempt and its necessity, Luna will circulate a letter on Wednesday. She believes that by explaining the concept and highlighting the disregard for subpoenas and the existence of a two-tiered justice system, her fellow representatives and the American people will understand the need for strong action.
Luna has the option to deem her bill "privileged," which would require the House to act on it within two legislative days. However, she has stated that she will defer to the leadership's preferred schedule if the Wednesday vote is called off or delayed due to concerns from moderate Republicans.
The House Republicans' move to hold Garland in contempt stems from his refusal to release audio recordings of Special Counsel Robert Hur's interviews with President Biden. Fox News Digital has reached out to the DOJ for comment but has yet to receive a response.
As tensions rise within Congress regarding the issue of accountability, Luna's determination to force a vote on the arrest of Attorney General Garland signals a growing demand for transparency and equal treatment within the justice system. Whether her resolution gains enough support remains to be seen, but it underscores the deeply polarized political landscape surrounding the highest levels of government.
