Parents of Accused Texas School Shooter Not Liable in Santa Fe High School Trial

In a three-week long civil trial, the parents of accused Texas high school shooter Dimitrios Pagourtzis, Antonios Pagourtzis and Rose Marie Kosmetatos, have been found not liable in the 2018 Santa Fe High School shooting that claimed the lives of 10 people and left 13 others injured. The trial concluded on Monday with the jury attributing the responsibility for the tragic incident to Dimitrios Pagourtzis himself and a firearms ammunition retailer.
Attorneys representing the victims' families had attempted to prove that Antonios Pagourtzis and Rose Marie Kosmetatos failed to prevent the massacre and provide necessary psychiatric treatment for their son. However, the jury ultimately placed the blame squarely on Dimitrios Pagourtzis, as well as the firearms ammunition retailer, in a verdict that awarded the impacted families a total of over $300 million in damages for pain and mental anguish.
Expressing disappointment with the outcome, Clint McGuire, the attorney representing several of the victims' families, stated, "We would've liked to have the parents share in their responsibility for this."
Dimitrios Pagourtzis, now 23, is facing capital murder charges for the shooting, but the criminal case has been put on hold since November 2019 when he was deemed incompetent to stand trial. Currently, Pagourtzis is being held at a state mental health facility.
During the trial, Defense Attorney Lori Laird argued that the parents had no reason to suspect their son's intentions or question his behavior prior to the May 18, 2018 shooting. She claimed, "The parents did not consent to any amount of this, and it is also the failure of the school and Lucky Gunner."
Lucky Gunner, the firearms ammunition retailer implicated in the case, has already settled a claim filed by family members of the shooting victims. The company's CEO, Jake Felde, asserted that his company bore no responsibility for the damages awarded by the jury, as Lucky Gunner had been dismissed from the lawsuit.
The attorney representing Dimitrios Pagourtzis argued that while his client had planned the shooting, he was not in control of his actions due to his severe mental illness.
As the families await compensation for the damages awarded, it remains uncertain how the parents, Antonios Pagourtzis and Rose Marie Kosmetatos, will receive the millions of dollars owed to them while their son remains hospitalized in a state mental health facility.
The lawsuit was filed by relatives of seven individuals who lost their lives in the Santa Fe attack and four of the thirteen who were injured.
