Judge Grants Hunter Biden's Request to Delay Tax Trial, Rescheduling for September

In a recent development, U.S. District Court Judge Mark C. Scarsi has granted Hunter Biden's request to postpone his tax trial scheduled to begin next month in California. Biden's legal team successfully motioned to move the trial start date from June 20 to September 5.
Last month, Judge Scarsi denied Biden's attempt to dismiss or reduce the counts in the indictment, which include allegations of tax evasion, failure to pay taxes, failure to file, and filing a fraudulent form. Biden's attorney, Abbe Lowell, contended that the June 20 trial date did not provide ample time for preparation due to Biden's simultaneous gun charges trial in Delaware, set to commence on June 3.
Lowell expressed concerns that the gun case might extend longer than anticipated, leaving insufficient time to transition to the tax trial. Additionally, he stated that Biden's defense team has faced difficulties in obtaining defense experts due to the high-profile nature of the case. One confirmed tax expert, currently involved in a separate trial, requires more time for preparation after the conclusion of their ongoing trial.
Lowell also emphasized the need for extra time to adequately prepare Biden for potential testimony. However, the prosecutor for special counsel David Weiss' office, Leo Wise, argued that any delay would have consequences. Wise mentioned that his team had already subpoenaed 30 witnesses who had arranged their schedules for June.
Wise also dismissed the defense's claim of difficulties in finding experts, stating that experts could be hired at any price and could offer any opinion. He described both the gun charges and tax trial as "simple cases" that were not complex or challenging.
During the back-and-forth discussion, Judge Scarsi initially expressed reluctance to grant the request, given that the trial date had been set before the Delaware court scheduled Biden's gun charges trial for June 3. However, after a lengthy debate with Lowell, Scarsi eventually relented, considering the attorney's reasons for the delay, including appellate decisions, a family vacation, and another unrelated oral argument in the Fifth Circuit.
In his order, Judge Scarsi definitively concluded that the trial would proceed on September 5, refusing to entertain any further postponements. This decision comes a day after a federal appeals court denied Hunter Biden's request to delay his gun charges trial, which stems from the possession of a firearm while using narcotics.
As of now, Biden's attorney, Abbe Lowell, has not commented on Judge Scarsi's ruling. Additionally, the office of special counsel David Weiss has declined to provide any statements regarding the matter.
