Hunter Biden's Indictment on Federal Gun Charges Upheld by Appeals Court

In a recent court document released on Thursday, the United States Court of Appeals for the Third Circuit rejected Hunter Biden's appeal to dismiss his indictment on federal gun charges. The president's son is now scheduled to face trial next month in Delaware.
The court document stated, "The defendant in this criminal case appealed three pretrial orders entered on April 12, 2024, denying his motions to dismiss the indictment." It further explained that the appeal was dismissed as the defendant failed to demonstrate that the District Court's orders were appealable before the final judgment.
Biden's legal team had previously filed a motion in federal court, arguing that a diversion agreement, which was previously agreed upon by the Department of Justice and Biden's lawyers, should remain in effect. Last year, Biden was indicted for purchasing a revolver in 2018 while actively using narcotics. He faces three felony charges related to the incident and has pleaded not guilty to all counts.
While Biden acknowledged his struggles with substance abuse during that period, including crack cocaine, his defense team asserted that he did not break the law and argued that another nonviolent, first-time offender would not have faced charges. The initial plea deal, which could have resolved the case without a trial, fell through in July 2023 when a judge, who was supposed to approve it, raised further questions.
Biden's attorneys have since sought to have the case dismissed, contending that political pressure influenced prosecutors after the public criticism of the initial agreement by Republicans, including former President Donald Trump, who referred to it as a "sweetheart deal." They also argued that the immunity provisions from the original agreement remained in effect. Biden's defense attorney, Abbe Lowell, urged Judge Maryellen Noreika to issue a final ruling on the matter.
In addition to the upcoming trial in Delaware, Biden is also expected to face trial on June 20 in Los Angeles for federal tax charges brought against him as part of the same investigation led by Special Counsel David Weiss.
