Texas Attorney General Appeals Decision Allowing Biden and Mayorkas to Destroy State's Border Barriers

Texas Attorney General Ken Paxton has taken action against a federal judge's decision that permits President Joe Biden and Homeland Security Secretary Alejandro Mayorkas to continue destroying the state's border barriers. This comes after Texas requested the court to prevent the federal government from cutting, damaging, or interfering with Texas's concertina wire fence until a final trial can be held.
Attorney General Paxton filed a lawsuit and a motion for preliminary injunction against the Department of Homeland Security (DHS), Secretary Mayorkas, and other agencies and officials in October. The lawsuit was in response to federal agents destroying Texas's concertina wire and allowing a constant stream of aliens to enter the state. Shortly after filing this lawsuit, a federal judge granted a temporary restraining order on an emergency basis.
Although the court denied Texas's motion, it found no merit in the Biden Administration's arguments that the wire fence hinders Border Patrol operations or emergency response efforts. The court declared that the defendants have failed in deterring unlawful entry, and the Biden Administration cannot use their statutory duties as an excuse to puncture Texas's attempts to strengthen border security or destroy their property. The court also noted the Biden Administration's practices directly contradict their obligations and pose life-threatening risks.
In response to the decision, Attorney General Paxton expressed disappointment, stating, "I am disappointed that the federal government's blatant and disturbing efforts to subvert law and order at our State's border with Mexico will be allowed to continue. Biden's doctrine of open borders at any cost threatens the safety of our citizens, and we will continue to fight it every step of the way."
The Attorney General's office, along with the Texas Public Policy Foundation, will appeal the decision to the U.S. Court of Appeals for the Fifth Circuit. Their aim is to defend Texans from the dangerous consequences of the Biden administration's policy of dismantling deterrents to illegal immigration.
In another development, Attorney General Paxton has notified United States Secretary of Homeland Security Alejandro Mayorkas about a new Texas law that grants Border Patrol agents additional authority in specific circumstances. This law aims to bolster border security and assist agents in their duties to protect the state.
To address the immediate concerns, Attorney General Paxton successfully obtained an emergency restraining order after federal agents were caught destroying barrier fencing to facilitate the entry of aliens near the Texas-Mexico border. This order highlights the urgency of maintaining border barriers to prevent unauthorized entry and protect the safety of Texas residents.
