Music Producer's Wife Files Lawsuit Against Nashville Police Officer Over Husband's Death

In a tragic incident that unfolded in Hermitage, Tennessee, a lawsuit has been filed against the Metro Nashville government and one of its police officers following the death of a well-known music engineer. Mark Capps, who had worked with renowned artists such as Alabama, Ronnie Milsap, and Amy Grant, was shot and killed by officers during a domestic violence incident. Now, Capps' wife, Tara, is seeking justice for her husband's untimely demise, alleging that he never posed a threat to the police.

The incident occurred when Capps, aged 54, became the subject of a domestic violence report involving his wife and stepdaughter. He had warrants against him for two counts of aggravated assault and aggravated kidnapping. According to the police, the two victims fled the home early in the morning after Capps threatened them at gunpoint. They promptly sought refuge at the Hermitage precinct, where detailed statements were taken, and warrants were subsequently issued.

The lawsuit filed by Tara Capps describes her husband as experiencing an "acute mental health and substance abuse episode" at the time of the incident, affecting not only him but also three members of their family, including Tara's daughter and her daughter's boyfriend, who worked for the Tennessee Bureau of Investigation.

In a video captured during the encounter, officers are seen shooting at Capps through the door after instructing him to show his hands. Within seconds, the officers fatally shot him. However, Tara Capps insists that her husband did not have a gun in his possession at the time of the incident, and no firearm was found near him during the subsequent search of the premises.

The lawsuit further alleges that the police's lack of attempted dialogue with Capps is concerning. Thirteen SWAT officers were deployed to the scene, but instead of first trying to establish communication with him, they immediately began setting up for a breaching situation. Ultimately, the officers fatally shot Capps without any attempt at dialogue.

It is worth noting that the officer who shot Mark Capps, Ashley Coon, has a troubled history documented in her personnel file. As per the information obtained, Coon has a history of use of force incidents and has received eight suspensions throughout her career. These concerns raise questions regarding the officer's previous conduct and the handling of the situation that resulted in Capps' death.

Currently, all officers involved in the case have been cleared to resume duty, according to the Metro Nashville Police Department officials in early October. However, this lawsuit adds a new layer to the ongoing discussion around police accountability and use of force.
