A groundbreaking verdict in New Mexico has resulted in a man being awarded over $412 million in a medical malpractice lawsuit against a national men's health clinic. The verdict, celebrated by the plaintiff's lawyers, is seen as a potential deterrent against similar fraudulent practices in the future. The attorneys highlighted the case's significance, noting that the award represents the largest sum ever granted by a jury in a U.S. medical malpractice suit.
"This is a landmark case and a rightful decision because no licensed professional should be defrauding patients for monetary gain. Such behavior breaches their fiduciary duty," remarked Lori Bencoe, one of the plaintiff's attorneys. She emphasized that the case underscores the importance of maintaining trust in medical professionals.
The trial, held earlier this month in Albuquerque, centered on a lawsuit filed by the man's legal team in 2020 against NuMale Medical Center and its officials. Allegations included fraudulent misdiagnosis and unnecessary treatments involving risky erectile dysfunction injections that resulted in permanent damage.
Nick Rowley, another attorney for the plaintiff, criticized the clinic's practices, stating, "This corporate scheme exploits fear to coerce men into undergoing unnecessary treatments." The complaint revealed that the man, aged 66, visited the clinic in 2017 seeking help for fatigue and weight loss but ended up suffering irreversible harm from the invasive treatments.
NuMale Medical Center, with clinics in multiple states including Colorado, Florida, Illinois, Nevada, Nebraska, North Carolina, and Wisconsin, expressed their disagreement with the jury's decision and announced plans to appeal.
"We respect the judicial process, but due to ongoing legal proceedings, we cannot comment on specific details of the case at this time," said Brad Palubicki, the President of NuMale Medical Center, in a statement to The Associated Press. He assured that the company remains committed to delivering responsible patient care and adhering to strict safety and compliance standards.
Court records indicate that the jury found the defendants' fraudulent and negligent actions caused significant harm to the plaintiff and violated the Unfair Practices Act. The man's attorneys stated that the verdict conveys a clear message that medical providers who place profits over patient care will be held accountable.
