Judge Decides Whether Prince Harry's Immigration Records Will be Made Public

In a highly anticipated case, Judge Carl Nichols, a Trump-appointed jurist known for his connections to the conservative Federalist Society, and for his involvement in the sentencing of January 6th Capitol rioters, is set to decide whether Prince Harry's immigration documents will be made public.

The issue arose after the release of Prince Harry's memoir "Spare," in which he admitted to using drugs on multiple occasions. Right-wing advocacy group the Heritage Foundation sued the Department of Homeland Security (DHS) in a bid to gain access to the records. Judge Nichols recently ordered DHS to provide declarations explaining the potential harm that may result from disclosing the application.

Donald Trump, who appointed Judge Nichols in 2018, voiced his disapproval of Prince Harry, stating that he would not protect him if he were re-elected. The ex-president called Prince Harry's move to the US an "unforgivable" betrayal of Queen Elizabeth II.

Despite concerns about bias, Judge Nichols has displayed independence in his decisions. In 2020, he issued an injunction blocking restrictions on the use of TikTok, an action supported by Trump. In addition, he sentenced individuals involved in the January 6th Capitol riot, including imposing a 30-day imprisonment and a restitution payment on former tech executive Bradley Rukstales.

Judge Nichols' ruling on a conspiracy charge related to the January 6th events also set a precedent that could be utilized in the defense of other accused rioters.

However, some controversies have surrounded his judgments. In a case involving child trafficking and forced labor allegations against Apple and Microsoft, it was revealed that Judge Nichols held financial investments in both companies.

The judge is a member of the Federalist Society, although it remains uncertain if he is currently active in the group. The Federalist Society, while non-partisan, is closely aligned with Republican priorities.

The court proceedings regarding Prince Harry's immigration records have attracted significant attention. The Heritage Foundation argues that Prince Harry's admission of drug use in his memoir raises concerns about his legal entry into the country. If he is found to have lied on his immigration paperwork, he may face removal or be barred from re-entry.

Judge Nichols has ordered in camera review of the documents, meaning that he will privately examine the records to determine if any exemptions prevent their release. The Department of Homeland Security has maintained that the records are sensitive and should be protected, despite Prince Harry's celebrity status and openness about his private life.

The DHS has questioned the veracity of Prince Harry's claims in his memoir, suggesting they may have been included for publicity purposes rather than as sworn testimony.

Judge Nichols has given DHS until March 21 to submit declarations explaining the records being withheld and the potential harm that may arise from their public disclosure.

The decision on whether Prince Harry's immigration records will become public knowledge now rests in the hands of Judge Carl Nichols.
