In a three-year legal battle, popstar Katy Perry and her husband, Orlando Bloom, have emerged victorious over a disabled veteran regarding the sale of a $15 million Montecito home. The couple purchased the 8.9-acre estate in Santa Barbara in 2020 from 84-year-old Carl Westcott, who later attempted to rescind the contract, claiming he was under the influence of painkillers at the time.
Westcott, who suffers from Huntington's Disease, argued that the effects of the painkillers wore off days later, causing him to realize what he had agreed to and seek to cancel the deal. However, a Los Angeles judge ruled in favor of Perry and Bloom, stating that Westcott presented no persuasive evidence to support his lack of capacity at the time of signing the real estate contract.
The ruling was delivered by Los Angeles County Superior Court Judge Joseph Lipner, who highlighted the inconsistencies in Westcott's own medical expert's testimony about his condition. The judge concluded that Westcott had breached the contract by changing his mind and that the damage trial phase is scheduled for February 13 and 14, during which the issue of lost rent will be addressed.
Katy Perry's attorney, Eric Rowen, expressed confidence in wrapping up the matter during the trial phase. Perry had demanded millions of dollars in lost rent from Westcott, asserting that they could have charged for the eight-bedroom home.
Carl Westcott, an 80-year-old veteran of the US Army 101st Airborne, had not listed the property or spoken to a broker about selling the stunning 9,285 square-foot home. He had intended to live there as his primary residence "for the rest of his life" but underwent major back surgery and subsequently signed the offer presented by real estate agents representing Perry and Bloom.
The legal battle between Perry and Bloom and Westcott is reminiscent of a previous property dispute involving the popstar. In 2015, Perry was embroiled in a legal fight with elderly Roman Catholic nuns over the sale of a convent. Ultimately, Perry won the case, with a judge ruling in her favor and awarding damages totaling over $15 million.
The victory for Katy Perry and Orlando Bloom in their long-standing legal battle over the Montecito property solidifies their ownership and plans for the home. Despite the controversy surrounding the sale, the couple had previously expressed their excitement about turning the estate into a family retreat and a place to raise their daughter, Daisy Dove.
