In a clash of the giants in the stuffed toy industry, Build-A-Bear and Jazwares, the maker of 'Squishmallows' and owned by Warren Buffett's Berkshire Hathaway, have filed dueling lawsuits against each other. The legal battle centers around allegations of design infringement and intellectual property rights.

On Monday, Jazwares, represented by Berkshire Hathaway, lodged a complaint against Build-A-Bear in the federal court of Los Angeles. Jazwares accuses its rival of blatantly and intentionally copying the look and feel of Squishmallows with its newly launched Skoosherz line of toys. The lawsuit alleges that Build-A-Bear deliberately undermined Jazwares' reputation and caused significant confusion among consumers. Jazwares is seeking an order to stop Build-A-Bear from producing Skoosherz and demanding three times the amount in unspecified damages.

Build-A-Bear quickly responded by filing its own lawsuit in the federal court of St. Louis. The company argues that Squishmallows lack a consistent look and feel, and asserts that Skoosherz is merely the latest iteration of the popular "soft, pillow-like squishie-type" toys that have been trending for several years. Build-A-Bear is seeking a court declaration that it did not infringe on Jazwares' "trade dress" rights in Squishmallows and insists that such rights are unenforceable.

Jazwares became a part of Berkshire Hathaway's portfolio when the conglomerate acquired its parent company, Alleghany, in October 2022. With the financial backing of Warren Buffett's massive investment firm, Jazwares aims to protect its intellectual property and safeguard the distinct identity of its Squishmallows brand.
