UC Berkeley Probes Title IX Complaint Following Clash Over Pro-Palestinian Speech at Law Professor's Home

The University of California, Berkeley, is currently conducting a Title IX civil rights investigation into allegations of harassment against a law professor. The probe focuses on an incident that took place during a dinner at the professor's residence involving a Muslim student who wished to deliver a pro-Palestinian speech.

The investigation, led by the university's Office for the Prevention of Harassment and Discrimination, centers around an event that occurred on April 9, 2024, at the off-campus home of professor Catherine Fisk and her husband, who serves as the dean of Berkeley Law School.

According to graduating law student Malak Afaneh, she experienced harassment and discrimination when she attempted to deliver an impromptu pro-Palestinian speech during the invitation-only dinner. Afaneh alleges that Fisk physically grabbed her and tried to forcibly take her cell phone and microphone, demanding that she leave the premises upon starting her speech.

Confirming the investigation, the Office for the Prevention of Harassment and Discrimination provided Afaneh with a document outlining the specific allegations against the professor. Attendees recorded video footage of the incident, capturing Fisk attempting to wrestle the microphone from Afaneh's hands. After a brief struggle, Fisk released her grip.

Towards the end of another video, Fisk acknowledged the student's concerns, stating, "We agree with you about what's going on in Palestine."

Afaneh, who is actively involved in the anti-war encampment at UC Berkeley, decried the incident as "clear Islamophobia" and accused Fisk of stifling her voice due to her pro-Palestinian beliefs. Fisk's husband, Erwin Chemerinsky, who is Jewish, has called the disruption "ugly and divisive."

Expressing her dismay and concern over the incident, Chancellor Carol Christ released an email statement at the time, stating that she was "appalled and deeply disturbed" by what transpired. She offered her support to both Fisk and Chemerinsky.

The clash has ignited a broader debate surrounding free speech and allegations of Islamophobia and anti-Semitism on college campuses, where students have been protesting against the war in Gaza.
