In his bid for re-election, former President Donald J. Trump has signaled a renewed focus on limiting legal immigration, a hallmark of his 2016 campaign. This week, Trump, alongside his running mate, Senator JD Vance of Ohio, outlined plans that would curtail programs allowing lawful entry into the United States.

During an interview with NewsNation, Trump expressed intentions to revoke programs like Temporary Protected Status, which currently allows tens of thousands of Haitian immigrants to reside in the U.S. legally. This stance was reiterated following Trump's inflammatory comments about the Haitian community in Springfield, Ohio.

Senator Vance also indicated that a potential Trump administration might eliminate asylum programs that enable undocumented immigrants to apply for protection once they are already in the country. He criticized the use of an app that helps migrants secure legal status, likening it to what he described as an "open border wand" by Vice President Kamala Harris.

The Biden administration defends these initiatives, arguing they provide structured pathways amid unprecedented levels of global migration. They contend that these measures are essential for managing the influx of people at the southern border.

Trump has not differentiated between legal and illegal immigration in his current campaign rhetoric. He has pledged to reinstate and broaden several restrictive measures from his previous term, including a travel ban affecting countries with Muslim-majority populations and extending it to refugees from the Gaza Strip.

Karoline Leavitt, a spokeswoman for Trump’s campaign, stated that programs like Temporary Protected Status for Haitians have overstayed their intended purpose. She emphasized that under a Trump administration, Haitian immigrants benefiting from such programs would be sent back to their home country.

Reflecting on his first term, Trump’s administration frequently faced legal challenges while attempting to implement hardline immigration policies through executive actions. Allies now suggest that the regulatory process might be a more effective route, especially in a legal landscape shaped by decisions from conservative-leaning courts.

Observers note that the judicial response to these proposed changes could be mixed. Key legal precedents and the composition of the courts will play pivotal roles in determining the outcomes. Notably, during his previous tenure, Trump’s administration implemented travel bans, scaled back refugee admissions, restricted asylum avenues, and sought to dismantle the DACA program, which shields young immigrants brought into the U.S. as children from deportation.
