Trump's Legal Team Seeks Federal Court Intervention in New York Criminal Trial

Lawyers representing former President Donald Trump have filed a motion urging a federal court to seize his ongoing criminal trial in New York, citing alleged "Constitutional violations" and discordance with the Supreme Court's recent ruling on presidential immunity. In a filing made on Thursday, the attorneys argued that the continuation of the proceedings poses direct and irreparable harm to President Trump, who is actively considering a run for the 2024 Presidential election, and to voters beyond the confines of Manhattan.

The lawyers further emphasized concerns over an impending sentencing scheduled for September 18, 2024, which they claimed could unlawfully imprison President Trump and hamper his groundbreaking campaign. They asserted that post-trial removal is necessary to provide an impartial forum, free from local hostilities, where Trump can address the alleged Constitutional infringements.

In May of an unspecified year, President Trump was found guilty on 34 counts related to falsifying business records in the first degree. These charges stemmed from an investigation led by Manhattan District Attorney Alvin Bragg into alleged hush money payments made prior to the 2016 presidential election. Trump's attorneys alleged that the District Attorney's office violated the Presidential immunity doctrine during grand jury proceedings and the subsequent trial by presenting evidence related to Trump's official acts during his first term in office.

Citing a recent ruling by the Supreme Court, the attorneys argued that such violations undermine the structure of the federal government and the abilities of future Presidents to fulfill their duties as intended by the Founding Fathers. They maintained that the Supreme Court concluded that President Trump is entitled to immunity from criminal prosecution for official acts and that prosecutors may not employ evidence of official acts in relation to a prosecution arising from unofficial conduct.

Trump campaign spokesman, Steven Cheung, expressed support for the legal team's efforts, describing the investigation by the Manhattan DA's office as a "Witch Hunt." Cheung highlighted the alleged infringements of the United States Constitution and the Supreme Court's definitive decision regarding Presidential immunity as reasons for the case's removal to federal court and its ultimate dismissal.

It's worth noting that a federal judge previously rejected a similar attempt by President Trump to transfer the criminal case out of New York state court in July of an undisclosed year. The judge determined that the hush money payments made to an adult film star were unrelated to the President's official acts and did not fall under the purview of his duties.

The outcome of Trump's latest bid to have the trial moved to federal court, seek redress for alleged Constitutional violations, and overturn his conviction remains to be seen.
