Former President Donald Trump is continuing his legal battle in the New York hush money case by appealing to the Second Circuit Court of Appeals, according to a notice of appeal filed on Tuesday night. This comes after a federal judge in Manhattan denied Trump's initial request to move the case to the Southern District of New York.

Trump's attorneys filed the notice of appeal last week, seeking to move the state case to federal court following the Supreme Court's presidential immunity decision. Alongside requesting the transfer, they also asked the federal judge to postpone Trump's sentencing, which is currently scheduled for September 18.

Last week, Trump's legal team urged Judge Juan Merchan to delay his decision on presidential immunity, allowing the process in federal court to unfold. However, Merchan had previously stated that he would rule on the matter on September 16.

In response to Trump's request for a pause in the state proceedings, the Manhattan district attorney's office filed a letter stating that there is no basis for the relief sought, as there is currently no pending notice of removal with the federal court. The letter, however, did not address Trump's notice of appeal.

With regards to Trump's separate request to delay his sentencing until after the election, Judge Merchan has yet to make a ruling on the matter.
