TICKET Act Receives Overwhelming Support in the House of Representatives, Moves to Senate

In a significant development for ticketing industry reform, the United States House of Representatives passed the Transparency in Charges for Key Events Ticketing (TICKET) Act with a resounding bipartisan majority of 338-24. The bill, which aims to bring greater transparency and consumer protection to ticket sales, received unanimous approval from the House Energy and Commerce Committee in December 2023.

Introduced by Representatives Jan Schakowsky (IL-09) and Gus Bilirakis (FL-12), the TICKET Act proposes several crucial measures. It mandates simple all-in pricing for ticket sales, bans speculative ticketing, prohibits deceptive websites and marketing practices, ensures full refunds for canceled events, offers comparable replacement tickets for postponed events with buyers' consent, and requires the Federal Trade Commission (FTC) to issue a report on the enforcement of the BOTS Act, passed in 2016.

Schakowsky celebrated the passing of the legislation, expressing excitement over the opportunity to protect consumers from fraudulent tickets, surprise costs, and excessive fees. She urged swift Senate approval to send the bill to President Joe Biden's desk for signature.

The TICKET Act has garnered widespread support across the ticketing industry. The Fix the Tix Coalition, representing various sectors of the music and live events industry, welcomed the legislation. They applauded the bill for promoting transparency through all-in pricing and addressing issues such as speculative tickets and misleading websites. They called on the Senate to build on this progress by strengthening the provisions, increasing BOTS Act enforcement, and offering more avenues to combat predatory and deceptive practices.

The National Independent Venue Association (NIVA) also commended the House's decision and urged the Senate to support the Fans First Act, which includes additional provisions to protect ticket buyers from deceptive websites and bots.

Live Nation Entertainment, a major player in the industry, expressed their support for the TICKET Act and stated that they have already implemented all-in pricing. They also backed additional ticketing reforms such as stronger anti-bot legislation and a ban on speculative ticketing and other predatory resale practices.

The Ticket Buyer Bill of Rights Coalition acknowledged the milestone achieved by Representatives Bilirakis and Schakowsky, noting that it marks the most significant federal live event ticketing reform in nearly a decade. They emphasized the importance of comprehensive reform that has consensus among all stakeholders, and called for swift Senate action to send the TICKET Act to President Biden for final approval.

Harvey Mason Jr., CEO of the Recording Academy, praised the passage of the TICKET Act, highlighting its significance in improving the concert ticket marketplace. Mason Jr. urged the Senate to quickly incorporate the provisions of the Fans First Act to ensure transparency and protection for artists and their fans.

Now, with the TICKET Act moving to the Senate, its fate is yet to be determined. However, the overwhelming support it received in the House of Representatives signals a strong momentum for much-needed ticketing industry reforms that aim to prioritize consumer well-being and enhance trust in the ticketing system.
