Kansas Governor Vetoes Controversial Measures on Gender-Affirming Care and Abortion Reporting

In a move that sets the stage for intense confrontations with the Republican-controlled Legislature, Democratic Governor Laura Kelly of Kansas on Friday vetoed a proposed ban on gender-affirming care for minors. The veto also includes a measure that would require more reporting from abortion providers, as well as a bill that aims to criminalize coercion into having an abortion.
The vetoed measures, which had garnered enough support in both chambers to override vetoes, highlight the ongoing battle over social issues such as abortion rights and LGBTQ+ rights in the state. However, Governor Kelly's strong support for abortion and LGBTQ+ rights has put her at odds with the Republican-supermajority Legislature.
Kansas has previously been an outlier among Republican-led states when it comes to abortion rights. In 2019, the Kansas Supreme Court declared that the state constitution protects abortion rights, and a statewide vote in August 2022 confirmed that position.
Governor Kelly justified her veto of the abortion reporting bill by stating that "voters do not want politicians getting between doctors and their patients by interfering in private medical decisions." She did, however, allow a GOP proposal on requiring pornography websites to verify the age of Kansas visitors to become law. This law will come into effect on July 1, following the lead of Texas and a few other states.
Regarding the proposed ban on gender-affirming care for minors, the Governor argued that the ban infringes upon parental rights and targets a small group. The bill would have prohibited surgical procedures, hormone treatments, and puberty blockers for minors, limiting their care to therapy only. Supporters of the ban claim that it would protect children from potentially dangerous and permanent treatments, while opponents argue that such care helps transgender children avoid depression and suicidal thoughts.
The Governor's veto also means that the licenses of any doctors violating the gender-affirming care ban will not be revoked, and recipients of state funds for treating children or state employees working with children cannot advocate for gender-affirming care. This restriction extends to the University of Kansas Medical Center in Kansas City, Kansas, prohibiting the use of state funding and property for such care.
While Republican lawmakers criticize Governor Kelly's stance on these issues, major American healthcare groups, including the American Medical Association and the American Academy of Pediatrics, recommend providing gender-affirming care for transgender youth. They argue that such care reduces the likelihood of mental health issues and suicidal thoughts.
It is worth noting that conservative legislators in Kansas have been active in enacting laws restricting transgender rights, including banning transgender girls and women from participating in female sports teams and removing legal recognition of transgender individuals' gender identities.
Despite the August 2022 vote affirming abortion rights, Republican lawmakers continue to push for new abortion regulations, arguing for "reasonable" restrictions and support for pregnant women and new mothers.
Governor Kelly's veto of the abortion reporting bill and the ban on gender-affirming care represents a clash between divergent ideologies in Kansas. The battle over these controversial measures is likely to continue as the Legislature may seek to override the veto.
