Judge Dismisses Nevada Fake Electors Case; AG Plans Immediate Appeal

In a significant turn of events, a Nevada judge has dismissed charges against six Republicans accused of falsely declaring that Donald Trump won the 2020 election in the state. The ruling came after the judge determined that the case was brought in the wrong jurisdiction, siding with defense attorneys who argued that Las Vegas was an improper venue for the trial.
Clark County District Court Judge Mary Kay Holthus issued the ruling on Friday, effectively scrapping the trial that was scheduled to begin in January. The defense attorneys contended that the case should have been brought in Carson City or Reno, where the alleged crimes took place, rather than in Las Vegas, known as the bluest city in Nevada.
Among the individuals indicted for their involvement in the so-called fake electors scheme were state GOP Chairman Michael McDonald, national party committee member Jim DeGraffenreid, Clark County Republican Party Chairman Jesse Law, national and Douglas County committee member Shawn Meehan, Storey County Clerk Jim Hindle, and Republican Eileen Rice from the Lake Tahoe area. All six defendants had previously pleaded not guilty to the charges.
The Nevada Attorney General's Office, led by Aaron Ford, has vowed to appeal the judge's decision to the state Supreme Court. Ford expressed disagreement with the ruling, stating, "The judge got it wrong, and we'll be appealing immediately."
Attorneys representing McDonald and Rice, Monti Levy and Richard Wright respectively, expressed their satisfaction with Judge Holthus' ruling. They expressed confidence that the Nevada Supreme Court would uphold her decision. Defense attorneys also highlighted the expiration of the statute of limitations, claiming that the state cannot bring the case before a grand jury in a different county as the three-year limit had already passed in December.
Nevada is among the swing states where Republicans filed false certificates, declaring Trump the winner of the 2020 election instead of Joe Biden. Similar charges have been brought against fake electors in other battleground states such as Georgia, Michigan, Wisconsin, and Arizona.
As the legal battle continues, the appeal to the Nevada Supreme Court will determine whether the dismissed case against the Nevada Republicans will be reinstated or permanently closed.
