Judge Denies Prosecution's Bid to Revive Manslaughter Charge Against Alec Baldwin

Judge Mary Marlowe Sommer issued a brief ruling on Thursday, stating that she could not consider the state's motion as it exceeded the 10-page limit.
During Baldwin's trial in July, Judge Marlowe Sommer dismissed the case with prejudice, a decision that was challenged by special prosecutor Kari Morrissey. Morrissey argued that the judge had made an error during the trial and contended that the case should not have been dismissed.
However, the judge refused to review Morrissey's arguments, citing the violation of page length rules. Despite submitting a 10-page version as ordered by the judge, Morrissey's motion was accompanied by an extensive 387-pages exhibit.
The original case against Baldwin stemmed from accusations that he negligently pointed a firearm towards cinematographer Halyna Hutchins while preparing for a scene on the set of the movie "Rust," resulting in Hutchins' tragic death.
The judge's decision to dismiss the case with prejudice was based on her finding that the state had deliberately withheld a cache of bullets from the defense. These bullets, according to the defense, could have been used to question the thoroughness of the sheriff's investigation.
In a motion filed on August 30, Morrissey argued that the bullets were irrelevant to the case and did not undermine Baldwin's guilt. She also stated that the state may consider appealing the judge's dismissal to a higher court.
It is important to note that the judge's ruling did not address the substance of Morrissey's motion but rather focused on the violation of the court's procedural rules regarding page length.
This is not the first time that the length of legal motions has become a point of contention in the "Rust" case. Baldwin's defense team had previously filed a lengthy objection to the state's failure to provide evidence, which was ultimately rejected due to excessive length.
