Judge Mary Marlowe Sommer issued a brief ruling on Thursday, stating that she could not consider the state's motion as it exceeded the 10-page limit.

The judge's decision to dismiss the case with prejudice was based on her finding that the state had deliberately withheld a cache of bullets from the defense. These bullets, according to the defense, could have been used to question the thoroughness of the sheriff's investigation.

In a motion filed on August 30, Morrissey argued that the bullets were irrelevant to the case and did not undermine Baldwin's guilt. She also stated that the state may consider appealing the judge's dismissal to a higher court.
