Although Hunter Biden has acknowledged his substance abuse issues during that time, his legal team maintains that he did not violate any laws. They argue that another nonviolent, first-time offender would not have been charged under similar circumstances. Furthermore, his lawyers claim that political pressure influenced the decision after an immunity provision from an original plea agreement fell apart and received criticism from Republicans, including former President Trump, who referred to it as a "sweetheart deal." Prosecutors, however, have firmly denied any political motivation behind the case.

The trial for the gun case is scheduled to begin with jury selection during the week of June 3. Meanwhile, Hunter Biden is also preparing for a trial in California on tax charges, set to take place on June 20. In the tax case, he is accused of being involved in a four-year scheme to evade paying $1.4 million in taxes while living a lavish lifestyle. Biden's legal team plans to appeal the judge's denial of a motion to dismiss the charges in that case.

In the court document giving notice of the interlocutory appeal, it is stated that Hunter Biden will be appealing to the United States Court of Appeals for the Ninth Circuit.
