In a bid to address the skyrocketing ticket prices for live shows, the House of Representatives has taken a major step towards regulating the ticketing industry. The TICKET Act, which stands for Transparency In Charges for Key Events Ticketing, was overwhelmingly supported by the House, with 338 representatives voting in favor of the bill.
Introduced by Illinois Democrat Jan Schakowsky and Florida Republican Gus Bilirakis last year, the TICKET Act aims to ensure transparency in ticket pricing. One of the key provisions of the legislation is the requirement for all-in pricing, meaning that ticket sellers must disclose the full price, including fees, in all advertising and promotional materials.
Speculative ticketing, a practice in which resellers offer the same ticket multiple times, would be banned under the proposed law. Deceptive websites and marketing tactics would also be prohibited, providing consumers with greater protection against fraudulent ticket sales.
Furthermore, the TICKET Act seeks to address the issue of canceled or postponed events. If the bill becomes law, sellers would be obligated to provide full refunds for canceled events and offer replacement tickets, with buyers' approval, for shows that have been postponed.
The TICKET Act also calls for the Federal Trade Commission to issue a report on the enforcement of the BOTS Act, a separate law enacted in 2016 to safeguard ticket buyers. The BOTS Act targets the use of automated software (bots) that can snatch up tickets in bulk, rendering them unavailable to genuine fans.
While Ticketmaster had already agreed to implement all-in pricing during a meeting at the White House last year, the TICKET Act aims to formalize this agreement and ensure compliance across the industry.
The bill now faces its next hurdle: approval by the Senate and review by the president before it can become law. Supporters of the TICKET Act are hopeful for a swift passage in the Senate to protect consumers from fraudulent tickets, surprise costs, and excessive fees.
With live performances being a cherished aspect of American culture, the TICKET Act presents a significant step towards making concert ticket prices more transparent and fair.
