In a recent development that adds fuel to the ongoing debate surrounding ethics reform within the Supreme Court, Ginni Thomas, wife of Justice Clarence Thomas, has expressed admiration for a legal group that opposes the Biden administration's efforts to implement a binding code of ethics for the justices. The revelation came through an email read by Kelly Shackelford, president and CEO of First Liberty Institute, during a call with major donors to the conservative political group, as reported by ProPublica.
In the email, Ginni Thomas praised the work of First Liberty Institute and thanked them for their support, saying, "YOU GUYS HAVE FILLED THE SAILS OF MANY JUDGES. CAN I JUST TELL YOU, THANK YOU SO, SO, SO MUCH." Shackelford, while sharing the email with donors, referred to it as an affirmation of their efforts in defending judges who are unable to engage in political advocacy. He further expressed appreciation for the donors' contribution in safeguarding the future of the court, highlighting the importance and impact of their support.
Not stopping at expressing gratitude, Shackelford went on to criticize Justice Elena Kagan, referring to her as "treasonous" and "disloyal" for advocating for an external mechanism to enforce the Supreme Court's ethics guidelines. These remarks reveal the deep divide surrounding the issue of ethical obligations and the need for accountability within the highest court of the land.
This development comes in the wake of another controversy involving Justice Samuel Alito, who refused to recuse himself from cases related to the events of January 6, despite reports that he had displayed flags associated with the movement to overturn the 2020 election results outside of his residences. Ginni Thomas has long been linked to the "Stop the Steal" movement that emerged after the 2020 election. She actively participated in efforts by pro-Trump Republicans to undermine the election results, sending numerous text messages to White House Chief of Staff Mark Meadows urging him to prevent what she called "the greatest Heist of our History." Thomas also encouraged Republican lawmakers to take to the streets in protest.

Senator Dick Durbin (D-Ill.) emphasized the urgent need for accountability, stating, "It's crystal clear that the highest court needs an enforceable code of conduct." Durbin criticized Chief Justice Roberts for his reluctance to use his existing authority to implement such measures, and vowed to continue pushing for the Supreme Court Ethics, Recusal, and Transparency Act until it becomes law.
