In an effort to address off-field incidents involving their athletes, the Georgia football program's NIL collective has been implementing fines on players. Kirby Smart, the Georgia coach, highlighted the fines imposed by the Classic City Collective during a recent interview. He stated that the collective had been fining players for various off-field issues and that this action was outside of his jurisdiction. However, these fines have not escaped controversy. Mit Winter, a lawyer specializing in NIL collectives, raised concerns about the potential employment status of athletes. While it is legally permissible for businesses to fine contractors, Winter suggested that these fines could blur the line between athletes and employees, especially if the collective is controlling their behavior. Additionally, if the directive to fine athletes comes from coaches or the school, it could lead to a host of legal issues.

One SEC coach expressed concerns about the potential negative impact of NIL fines on recruiting efforts. It remains to be seen how this approach will affect the perception of athletes considering Georgia and other programs that implement similar fines.

Over the past 18 months, more than 20 Georgia players have faced traffic-related charges, with at least seven arrests. The seriousness of such incidents cannot be overstated, as Georgia football player Devin Willock and staffer Chandler LeCroy tragically lost their lives in a car accident earlier this year.

Despite the alarming number of incidents, Coach Smart defended his program's efforts to address the problem. He emphasized the importance of education, driver safety, and disciplinary actions such as suspensions and dismissals. Smart pointed out that the Georgia football program has taken a stricter stance by suspending and dismissing players based on driving citations, a measure that he claims other college football coaches have not undertaken.
