Former Nebraska Congressman Jeff Fortenberry Faces Anticipation of New Indictment on False Statements Charges

Former Nebraska Congressman Jeff Fortenberry's spokesperson has revealed that another indictment is expected to be brought against him on charges of making false statements to the FBI. The original conviction, which took place in the Central District of California in Los Angeles in 2022, was later overturned by an appellate court in December 2023 due to jurisdictional issues.

According to Chad Kolton, Fortenberry's spokesperson, the Department of Justice is now seeking to retry the case, this time in Washington D.C. Kolton expressed concerns about the Justice Department's persistence in pursuing multiple trials until a conviction is obtained, despite the previous ruling in Fortenberry's favor.

The allegations against Fortenberry stem from accusations of lying to federal agents regarding an illegal $30,000 campaign contribution made by a foreign billionaire at a 2015 fundraiser in Los Angeles. The appellate court found that having the trial in California was improper, as the false statements were alleged to have been made during interviews conducted in Fortenberry's Nebraska home and a lawyer's office in Washington.

While Fortenberry's convictions have been reversed, allowing for the possibility of a retrial in a proper venue, Kolton maintains his client's innocence. He claims that the FBI was aware of Fortenberry's lack of knowledge about the illegal contributions and orchestrated the involvement of an informant to make comments about improper donations, which investigators later questioned him about.

Kolton criticizes what he perceives as overzealous prosecution and expresses his frustration at the retrying of the case in Washington D.C., suggesting that the prosecutors have a vindictive obsession with destroying Fortenberry's reputation. He emphasizes that Fortenberry has already resigned from his public office and served his sentence, making the continued legal proceedings a significant burden.

Fortenberry resigned shortly after his initial conviction in 2022, and now he awaits the potential retrial of the charges against him in the nation's capital.
