### DOJ Warns Musk's America PAC Over $1M Daily Giveaway Amid Legal Concerns

The Justice Department has taken aim at America PAC, a super PAC funded by billionaire Elon Musk, with a warning regarding its $1 million daily giveaway in key battleground states, according to sources who spoke to NBC News. The letter, sent by the department’s Public Integrity Section, raises concerns that the lottery could be violating federal election laws.

Neither the Justice Department nor the super PAC's treasurer have responded to requests for comments. This letter, which was initially revealed by CNN, follows increasing calls from both state and federal officials to scrutinize the legality of Musk's lottery, particularly in light of federal prohibitions against paying individuals to register to vote. Earlier this week, a group of former prosecutors and ex-government officials formally urged the Justice Department to launch an investigation into the matter.

Legal professionals diverge on whether Musk’s giveaway breaches election laws. According to Matthew Sanderson, an election law specialist affiliated with NBC News, while Musk’s contest might appear legally ambiguous, it does not necessarily cross a line. “I understand why some would argue it violates the law, but I don't think it does,” Sanderson remarked.

Federal regulations explicitly forbid payment for voter registration. The rules of Musk's America PAC lottery stipulate that participants must be registered voters in one of seven swing states and sign a petition supporting both the First and Second Amendments. The contest website underscores a goal to gather 1 million registered voters in these crucial states to back the Constitution’s provisions for free speech and the right to bear arms.

Additionally, Musk has indicated that participants must act as spokespersons for the petition, highlighting their support for free speech and gun rights in short promotional videos. Thus far, several winners have appeared in America PAC videos expressing their support for former president Donald Trump.

The contest, which Musk announced during a town hall event in Harrisburg, Pennsylvania, is open to voters in Arizona, Georgia, Michigan, Nevada, North Carolina, Pennsylvania, and Wisconsin. Musk has committed to giving away $1 million each day until Election Day, with four winners already named.

With a net worth of $240 billion, Elon Musk, the CEO of Tesla and SpaceX, holds the title of the world's wealthiest individual according to the Bloomberg Billionaires Index.
