Attorneys for Former President Trump Seek Removal of Fulton County District Attorney from Election Interference Case

Attorneys representing former President Donald Trump have filed a motion with a Georgia appellate court requesting the removal of Fulton County District Attorney Fani T. Willis from the 2020 election interference case. Trump's legal team accuses Willis of displaying "repeated public animosity" towards the former president and his co-defendants, thereby jeopardizing their right to a fair trial.

In their filing submitted on Monday, attorneys Steve Sadow, Jennifer Little, and Matthew Winchester argue that the Georgia Court of Appeals should disqualify Willis and her office from the case, ultimately leading to the dismissal of charges against Trump. The lawyers claim that Willis, who is Black, deliberately injected false allegations of racism into the proceedings, which have tainted the case.

The motion follows Trump and eight co-defendants' efforts to reverse a lower-court decision that allowed Willis and her office to remain on the case. Initially, the move to remove Willis was based on allegations of an improper relationship between her and an outside lawyer appointed to lead the investigation.

Additionally, Trump's legal team argues that Fulton County Superior Court Judge Scott McAfee erred in not disqualifying Willis due to remarks she made in a speech at an Atlanta Black church on January 14. In her speech, Willis suggested that criticism against her and then-special prosecutor Nathan Wade was racially motivated. While McAfee deemed the speech "legally improper," he questioned whether it constituted misconduct that would warrant disqualification.

Prosecutors have pushed back against the efforts to remove Willis, urging the appellate court to uphold McAfee's decision. The judge ruled in March that there was a "significant appearance of impropriety" and required either Willis and her office or Wade to step down from the case. Wade resigned later that day.

Trump's attorneys argue that Willis intentionally played the race card to bring public condemnation against the accused and divert attention from herself. They claim that Willis aimed to label the defendants and their attorneys, including Trump, as racists, which could potentially influence potential jurors in Fulton County.

The appellate court has scheduled oral arguments for December 5, following the upcoming Election Day where both Willis and Trump will be on the Fulton County ballot. A ruling from the three-judge panel - Trenton Brown, Todd Markle, and Benjamin A. Land - is expected by early March.

The case against Trump and his 14 co-defendants involves allegations of illegally conspiring to overturn his 2020 election loss in Georgia, with charges including racketeering. As the appeal is being considered, the appellate court's decision to stay the case has effectively put it on hold.

The outcome of Trump's appeal seeking to disqualify Fulton County District Attorney Fani T. Willis will determine the future proceedings in the election interference case. Currently, no trial date has been scheduled, awaiting a ruling on Trump's appeal.
