One of former President Donald Trump's current attorneys, Jennifer Little, reportedly spoke with federal investigators, revealing that she warned Trump about potential legal consequences if he failed to fully comply with a subpoena issued by the Justice Department. According to sources familiar with the matter, Little emphasized to Trump that non-compliance would amount to a crime.
The revelation from Little may shed further light on Special Counsel Jack Smith's accusation that Trump knowingly violated the law by hiding over 100 classified documents from the FBI and his own legal team. Smith's indictment, filed on June 9, alleges that Trump obstructed the Justice Department's efforts by concealing his continued retention of classified documents and submitting a false certification to the FBI claiming that all documents had been returned.
During a pivotal meeting at Trump's Mar-a-Lago estate, Little reportedly issued a stern warning to Trump, stressing the seriousness of the situation. Sources quote Little as telling investigators that she made it clear to Trump, "You've got to comply." Little allegedly recounted that Trump "absolutely" understood the gravity of the warning.
Evan Corcoran, another attorney on Trump's legal team, also emphasized the importance of compliance during the meeting at Mar-a-Lago, allegedly cautioning Trump that authorities might search the estate if he failed to comply with the subpoena.
The indictment against Trump alleges that he did not fully comply with the subpoena and failed to turn over all classified documents in his possession. The document further claims that Trump attempted to hinder the Justice Department's investigation by retaining classified documents and submitting a false certification.
Currently, Trump and his co-defendants have pleaded not guilty and denied any wrongdoing in the case. The spokespersons for the special counsel's office and Trump did not respond to requests for comment.
Jennifer Little, who previously worked as a Georgia state prosecutor, is representing Trump in a separate case related to the alleged conspiracy and racketeering charges stemming from the attempt to overturn Georgia's 2020 presidential election results. Little joined Trump's legal team in March 2021, shortly after the launch of the election-related probe in Georgia.
The investigation into Trump's handling of classified materials began after the National Archives repeatedly requested that he return any government documents he possessed. In January 2022, when Trump eventually returned 15 boxes of documents, nearly 200 classified documents were discovered inside them. This prompted the National Archives to refer the matter to the Justice Department, which subsequently issued a subpoena to Trump.
Sources indicate that during the meeting at Mar-a-Lago, Little attempted to clarify the distinction between the previous situation with the National Archives and the current legal ramifications of non-compliance with the subpoena. She supposedly conveyed to Trump that diligent search and return of any remaining classified documents would prevent any legal consequences. However, failure to do so after signing a certification of full compliance would constitute a crime, according to Little.
As the investigation continues, new details are emerging regarding the warnings issued to Trump by his attorneys. The extent of Trump's understanding of the potential consequences and his subsequent actions will likely play a significant role in the legal proceedings moving forward.
