North Dakota Lawmaker Faces Calls for Resignation Over Homophobic and Xenophobic Comments During DUI Stop

In a recent development, a growing number of Republican leaders in North Dakota are demanding the resignation of state lawmaker Rep. Nico Rios (R) after disturbing reports surfaced regarding his behavior during a DUI stop earlier this month. The incident, which took place on December 15, involved Rios being pulled over for a lane violation and subsequently being arrested for drunk driving.

According to The Associated Press, the police officer's report detailed Rios as being "verbally abusive, homophobic, racially abusive, and discriminatory" towards the officer. Taking a stern stance against Rios, Republican state House Majority Leader Mike Lefor issued a statement on Tuesday, asserting that such behavior has no place in the legislature or their party.

Lefor emphasized, "There is no room in the legislature, or our party, for this behavior. I understand people make mistakes, but his comments and defiance to law enforcement are beyond the pale. In addition, any lawmaker attempting to use his or her elected position to threaten anyone or skirt the law is completely unacceptable."

The North Dakota Republican Party Chair, Sandi Sanford, echoed Lefor's sentiments, emphasizing that Rios's actions and words are below the standard of basic decency expected from elected representatives. Sanford condemned Rios for endangering the community he serves and disrespecting peace officers, stating that such behavior violates the core values of the Republican Party.

Rios, in response to the mounting criticism, expressed remorse for his unacceptable behavior, offering an apology and a commitment to rectify the situation. In a statement on the social media platform X (formerly Twitter), he acknowledged, "Moving forward after this night, I feel like I have to emphasize my complete and total commitment to supporting Law Enforcement. I messed up big time, and I am truly sorry."

Further details from the incident emerged when police body camera footage obtained by the AP revealed Rios cursing at the officer, questioning his English accent, and using homophobic slurs and anti-migrant language. Rios also made reference to contacting the North Dakota attorney general and warned the officers that they would regret confronting him.

Rios, a member of North Dakota's House of Representatives since being elected in 2022, holds an oil field position outside of his political duties. At present, Republicans hold the majority control in the House, with an 82-12 split.

Amidst the ongoing controversy, neither Representative Nico Rios nor Majority Leader Mike Lefor has responded to The Hill's request for comment on the matter. The repercussions of Rios's actions and the calls for his resignation continue to reverberate throughout North Dakota's political landscape.
