In a new lawsuit filed in California federal court on Tuesday, a massage therapist named Kellye Croft has come forward with allegations of sexual assault against James Dolan, the boss of Madison Square Garden, and disgraced Hollywood producer Harvey Weinstein. The suit claims that Croft was pressured into a sexual relationship with Dolan in 2013, while on tour with the Eagles and Dolan's band, J.D. and the Straight Shot. It further alleges that a year later, she was sexually assaulted by Weinstein.
According to the lawsuit, Croft was initially hired to provide massages for the late Eagles frontman Glenn Frey during the tour, which was partially financed by Dolan's businesses. However, she was allowed to massage other members of the band and crew and gave Dolan her card. Unaware of Dolan's prominence, Croft claims that Dolan scheduled an appointment with her and she confided in him about being ostracized by other tour members. Dolan promised to handle the situation and subsequently engaged in sexual acts with Croft multiple times, despite her reluctance.
The lawsuit also details an encounter Croft had with Weinstein in January 2014. After Dolan arranged for Weinstein to meet Croft, he allegedly sexually assaulted her in a hotel room, making unwanted advances and attempting to penetrate her. Croft thwarted his advances when Dolan called her, giving her an opportunity to escape the situation. She later informed Dolan of the incident, who allegedly claimed that Weinstein was troubled and needed help.
The lawsuit seeks unspecified damages for the trauma and negative impact on Croft's life. It states that Croft's experiences led to depression and drug use, preventing her from continuing her career as a massage therapist.
A lawyer representing Dolan dismissed the allegations as meritless, stating that there is compelling evidence to support their position. The inclusion of Weinstein's name in the case was criticized as an attempt to inflame the situation. Dolan's attorney further claimed that the lawsuit was a form of retaliation by the lawyer representing Croft, who has previously filed a case against Dolan on behalf of former Knick Charles Oakley.
Weinstein's attorney denied the allegations, stating that Weinstein vehemently denies the claims and looks forward to litigating the case.
This lawsuit falls within a newly opened window for historical sexual offenses in California, allowing victims to come forward for incidents that occurred between 2009 and 2019. The lookback window will remain open until 2026, giving survivors an opportunity to seek justice for past abuses.
As the legal proceedings unfold, the case will delve into the allegations made by Croft against Dolan and Weinstein, shedding light on the actions of influential individuals and the experiences of those who have suffered from sexual assault.
