In a jaw-dropping decision, the Ohio Supreme Court unanimously voted to suspend Judge Daniel Gaul and remove him from his longstanding position as a Cuyahoga County Common Pleas judge. The ruling marks an ignominious end to Gaul's 30-year career on the bench and comes after a series of misconduct allegations.

The Ohio Disciplinary Counsel, responsible for investigating attorney misconduct, took issue with Gaul's behavior, which included making derogatory comments towards defendants, wrongfully imprisoning an offender in court, and coercing a man to plead no contest to a murder charge for which he was later found not guilty.

The state's highest court agreed with the Disciplinary Counsel's findings, describing Gaul's conduct as "egregious" and stating that he had "abandoned his role" as an unbiased and impartial arbiter. Chief Justice Sharon Kennedy expressed concern that Gaul's actions had seriously undermined confidence in the judiciary system, damaging the reputation of the court.

At 70 years old, Gaul is ineligible to seek re-election due to the state's age limit on judicial candidates. Consequently, this suspension effectively concludes his time on the bench, which would have lasted until 2024.

This is not the first time Gaul has faced disciplinary action. In 2010, he received a six-month suspended sentence on similar grounds. However, the recent investigation centered around incidents occurring between 2016 and 2017, which were widely documented by cleveland.com and The Plain Dealer.

One notable case involved Gaul comparing an acquitted man, who was convicted of illegally possessing a weapon, to a mass-murderer. The judge further made inappropriate remarks about the defendant's racial background, displaying clear biases and a lack of impartiality.

The court also scrutinized Gaul's handling of the Carlton Heard case. Gaul coerced Heard into pleading no contest to attempted murder charges just before his trial was scheduled to begin, subsequently sentencing him to 14 years in prison. However, Heard appealed the decision and was ultimately found not guilty by a different judge.

During the investigation, Gaul admitted in a hearing before the Board of Professional Conduct that he had no evidence that Heard had manipulated the system, thereby calling into question the judge's integrity and fairness.

Gaul's lawyer, Monica Sansalone, argued in his defense, citing his extensive career and the minimal number of misconduct accusations compared to his overall case load. Several individuals, including prosecutors, defense attorneys, court reporters, and Gaul's staff, submitted letters to the court attesting to his good character. However, Justice Pat Fischer dissented, suggesting a two-year suspension with one year conditionally stayed due to the severity of Gaul's actions and the harm inflicted on vulnerable individuals.

It is noteworthy that Judge Gaul's father, former Cuyahoga County Treasurer Frank Gaul, also had a tarnished career in public service. In 1995, Frank Gaul faced criminal charges for misappropriating over $66 million in county funds. Although initially convicted, an appeals court later overturned the verdict and cleared him of all charges.

Judge Gaul's removal from the bench is yet another case involving judicial discipline at the Justice Center. In October, Cleveland Municipal Court Judge Pinkey Carr received an indefinite suspension from the Ohio Supreme Court for her involvement in what was deemed an "unprecedented level of misconduct."

With Gaul's departure, the court hopes to restore faith in the judiciary system and uphold the principles of fairness, impartiality, and justice for all.
