Amazon Challenges National Labor Relations Board's Constitutionality in Legal Filing

In an intriguing turn of events, Amazon has joined SpaceX in contesting the constitutionality of the National Labor Relations Board (NLRB). As reported by The New York Times, Amazon recently filed a legal document claiming the NLRB is "unconstitutional." The filing is linked to a 2023 NLRB case that accuses Amazon of violating labor regulations at a Staten Island warehouse in New York.

According to the report, Amazon's lawyers argue that the company has not breached any labor laws. However, Amazon contends that the NLRB wields excessive power as a single entity, pointing out that it is responsible for establishing rules, investigating infractions, and determining legal violations. Furthermore, Amazon asserts that NLRB hearings can impose legal remedies without a jury trial, which the company claims is a violation of the Constitution.

This development mirrors a similar stance taken by SpaceX earlier this year. After the NLRB filed a complaint against SpaceX for allegedly firing employees critical of Elon Musk, the company sued, asserting that the NLRB infringed on its right to a trial by jury. Despite previous rulings in SpaceX's favor by a federal judge in Texas, the case has been transferred to California due to the location of the incident in question.

It remains to be seen how these challenges to the constitutionality of the NLRB will unfold, and whether they will impact the ongoing labor disputes between these tech giants and their respective employees. Amazon has not yet responded to requests for comments on the matter from The Verge.
