Trump's Lawyers Renew Request for Judge's Recusal in Hush Money Trial

In a renewed attempt to sway the outcome of former President Donald Trump's New York hush money trial, his defense lawyers have once again asked Judge Juan Merchan to recuse himself. This time, they argue that Merchan's daughter's employment with a digital consulting firm creates a potential conflict of interest.

Lawyers for Trump filed a letter on Monday contending that Merchan's daughter's work with Authentic Campaigns creates an "ongoing financial interest" tied to the former president's criminal trial. They assert that this financial connection may influence the judge's impartiality and warrant his recusal from the case.

Prosecutors from the Manhattan district attorney's office swiftly responded, stating that the defense's arguments were factually flawed and lacked any new information. In a filing on Tuesday, prosecutor Matthew Colangelo called for the immediate denial of the defense's request, asserting that there was nothing to suggest that the trial would directly benefit Judge Merchan's daughter or the consulting firm.

Last year, Trump's lawyers had previously sought Merchan's recusal, citing his political contributions to Democrats in 2020, his overseeing of the Trump Organization trial in 2022, and his daughter's role as a political consultant. However, Merchan had declined to recuse himself in August 2023, maintaining that he could remain fair and impartial.

The defense argues that since Merchan's previous decision, the circumstances surrounding the trial have changed significantly. They point out that Trump is now the presumptive Republican nominee for the 2024 election, making the case politically charged. They further highlight the role of Merchan's daughter as a political consultant at Authentic Campaigns, a firm that has worked for prominent Democratic clients, including President Joe Biden's 2020 campaign and Vice President Kamala Harris' presidential campaign.

Records reviewed by ABC News indicate that Authentic Campaigns has been paid nearly $12 million to date in the current election cycle. The defense argues that this financial connection cannot be ignored, suggesting that developments in Trump's criminal trial may provide fodder for fundraising and an opportunity for Authentic to profit.

Prosecutors, in their response, dispute the defense's claims of a financial conflict between Merchan and his daughter, stating that there is no direct connection between Authentic Campaigns and the case. They dismiss the defense's arguments as a chain of innuendos and emphasize the lack of evidence to support a personal interest on the part of the judge.

Trump, who pleaded not guilty to a 34-count indictment in April, stands accused of falsifying business records related to a hush money payment made by his former attorney, Michael Cohen. The former president maintains his innocence throughout the proceedings.

With the defense and prosecutors at odds over Judge Merchan's recusal, the fate of the hush money trial continues to be mired in legal wrangling and allegations of potential conflicts of interest.
