Missouri Attorney General Bailey Secures Court Order Against Biden Admin's Diversion of Border Wall Funding

In a significant legal victory for border security, Missouri Attorney General Andrew Bailey has obtained a court order compelling the Biden Administration to use congressionally appropriated funds for the construction of a barrier along the southern border. The court order comes after the Biden Administration failed to comply with the law mandating the completion of the border wall.
Attorney General Bailey stated, "The Biden Administration has neglected its duty to uphold the law and complete the construction of the wall along the southwest border. We took legal action to hold them accountable and ensure they fulfill their constitutionally mandated responsibilities. This is a crucial step in safeguarding our border at this crucial moment in our nation's history."
Last year, Congress passed a law that explicitly required the President to construct barrier systems at the southern border, allocating $1.4 billion for this purpose. The legislation clearly stated that the allocated funds "shall only be available for construction of barrier systems along the southwest border." Despite this, the Biden Administration chose not to comply with Congress' directive.
When questioned about their decision to not build a barrier, such as a wall, the Biden Administration responded that it was not their policy and that they disagreed with such construction. The Department of Homeland Security (DHS) even expressed its intention to cease any further expansion of the wall and called on Congress to cancel remaining funding for the project.
In response, Missouri, in conjunction with Texas, promptly filed a lawsuit challenging the Biden Administration's disregard for Congress' appropriations laws. Although the Administration argued that Attorney General Bailey did not have standing to challenge their diversion of funds, the Fifth Circuit Court of Appeals ruled that states do have the right to bring such challenges.
