Former Milwaukee Election Official Convicted of Absentee Ballot Fraud and Misconduct

In a highly unusual case that drew attention to baseless claims about election fraud, former Milwaukee election official Kimberly Zapata, 47, has been convicted of absentee ballot fraud and misconduct in office. Zapata, who served as Milwaukee's deputy elections director in 2022, generated three ballots under the names of fictitious military members and sent them to a leading election denier in an effort to expose vulnerabilities in Wisconsin's voting system.

The incident occurred during a time when unfounded allegations about election integrity were circulating among Republicans, including in the state legislature. Frustrated by what she saw as meritless issues overshadowing real concerns, Zapata decided to take matters into her own hands. Although no illegal votes were cast, Zapata's actions led to her termination, followed by charges of felony misconduct in office and three misdemeanor counts of absentee ballot fraud.

After a two-day trial, a jury in Milwaukee County found Zapata guilty. She now faces a maximum sentence of five years in prison and a $13,000 fine. In an interview with The Washington Post shortly after being charged, Zapata admitted that what she did was wrong, but maintained that her intention was to shed light on the need for improvements in the election system and regain trust in the American voters.

The spread of falsehoods about elections in Wisconsin had escalated after Joe Biden narrowly won the state in 2020. Republican lawmakers, in their attempt to challenge the election results, hired investigators who consulted with conspiracy theorists. The lead investigator eventually acknowledged that revoking the state's 10 electoral votes was impractical. Despite the baseless claims, election officials have emphasized that the charges against Zapata demonstrate the inefficacy of such schemes.

It is important to note that Wisconsin allows military members to cast absentee ballots without registering or providing proof of residency, a policy that Zapata regarded as problematic. She used a state website to have three ballots sent to State Representative Janel Brandtjen, a vocal supporter of discredited theories surrounding the 2020 election and the head of the Wisconsin State Assembly's elections committee at the time. Brandtjen acknowledged the incident, stating that it exposed a critical flaw in the state's online system for requesting absentee ballots.

Election officials have downplayed the incident, assuring that any large-scale creation of fictitious ballots would be swiftly detected. The case against Zapata also comes in the wake of conservative activist Harry Wait's attempts to exploit flaws in the state's absentee ballot application process. Wait, who made online requests for ballots meant for other people to be sent to his home, has been charged with multiple felonies and misdemeanors.

As this conviction highlights the importance of maintaining the integrity of the election system, the focus now turns to implementing necessary reforms to address legitimate concerns while ensuring fair and transparent elections in the future.
