In a bold move, 23XI Racing, co-owned by NBA legend Michael Jordan and driver Denny Hamlin, has refused to sign NASCAR's new charter deal for the 2025 season. This decision has left the team on an island, as the majority of teams have already signed the deal. The disagreement stems from concerns over an anti-disparagement clause and the lack of fair bargaining opportunities.

At the recent Southern 500 Cup Series race, 23XI Racing investor Curtis Polk made a statement by wearing a sign on his back that read, "Please don't ask me about my Charter. I don't want to disparage NASCAR and lose it." This was a clear jab at the potential anti-disparagement clause in the new agreement. When asked about it, Hamlin confirmed that it is indeed a threat, implying that speaking negatively about NASCAR could result in consequences.

While specifics about the ownership proposal remain undisclosed, it is evident that NASCAR and its teams have been struggling to reach a consensus on the new charter deal for 2025. Hamlin has been vocally critical of some of NASCAR's proposals and has used his platform to express his concerns.

On Saturday, 23XI Racing released a statement announcing their refusal to meet NASCAR's deadline and sign the new charter. This decision signifies the team's strong protest against the sport's leadership. The statement emphasized that 23XI Racing believes they were not given a fair opportunity to bargain for a new charter contract. They have communicated their concerns to NASCAR and expressed a desire for constructive discussions to address these issues and move forward in a way that strengthens the sport.

Tensions have been escalating, evident during last week's trophy ceremony at Darlington, where 23XI driver Tyler Reddick won the regular season title. Interestingly, NASCAR's leadership was noticeably absent from the ceremony. Hamlin expressed disappointment at the lack of NASCAR's presence during the celebration, further highlighting the strained relationship between the team and the sport's leadership.

The refusal to sign the charter is a significant step by 23XI Racing, drawing a clear line in the sand that other team owners have been unwilling to cross. The team believes it has enough leverage to demand changes, yet the future of negotiations and the path forward remain uncertain for both 23XI Racing and NASCAR's leadership. In media interviews, Hamlin expressed frustration, stating that negotiations seem to be moving in the wrong direction and labeling the proposed deal as "one-sided" in favor of the sanctioning body.

The standoff between 23XI Racing and NASCAR raises questions about the power structure in the sport. Hamlin questions the perceived concentration of power, referring to the potential consolidation of roles as the "jury, judge, and executioner." This proposed change signifies a significant departure from the traditional structure of decision-making within NASCAR.

It is worth noting that Front Row Motorsports has also reportedly declined to sign the agreement, as reported by FOX Sports journalist Bob Pockrass. However, as of now, no official statement has been released by FRM.

As both sides remain entrenched in their positions, it remains to be seen how this standoff will impact the future of 23XI Racing and NASCAR as a whole. The refusal to sign the charter highlights a growing discontent within the sport and calls for a more equitable approach to governing NASCAR.
